A Chapter 7 bankruptcy is often called a “straight bankruptcy.” If you qualify for Chapter 7 bankruptcy relief, you can have most of your debt discharged in about six months. Contrary to what you may have heard, it is often possible to keep and pay for a house and a car while still discharging most of your other debts.
In order to determine if you qualify, your income must be evaluated using a court-order calculation called the “Means Test.” You must also take an inventory of your current assets. Our attorneys will assist you with both the Means Test and the asset inventory during the initial consultation.
If you decide to file a Chapter 7, your case will be assigned to a Chapter 7 Bankruptcy Trustee. The Trustee’s job is to make sure that both you and your creditors are treated fairly throughout the bankruptcy process. You will be required to attend a court hearing called a “341 Meeting of Creditors.” One of our attorneys will be sitting right beside you to assist you at the hearing. Normally the 341 Meeting of Creditors is the only court appearance you will have to make.

A Chapter 13 is a court-supervised debt repayment plan. Over a period of three to five years you will pay back some or all of your debt. Our attorneys will help you write a repayment plan based on how much you can afford to pay and the total amount of debt that you have. Even if you are behind on a house or a car, a Chapter 13 can allow you to keep them and pay off the amount you are behind over time.
Once your Chapter 13 repayment plan is filed with the court, there will be two court hearings. The first hearing is a 341 Meeting of Creditors. The second is called a “Confirmation Hearing.” You must attend the 341 Meeting of Creditors, but one of our attorneys will be sitting right beside to assist you during the hearing. Usually one of our attorneys can appear for you at the Confirmation Hearing without you needing to be there. At the Confirmation Hearing, a judge will review your repayment plan to make sure that it is both fair to you and to your creditors. Once the judge confirms your repayment plan, then all parties have to abide by the plan that was proposed.
You do not receive a discharge in a Chapter 13 until all of the payments have been made and the plan has been completed.

I am a native of Chattanooga, TN and as a passionate musician, I’ve played in various bands since I was a teenager. Besides my love of music, art, and my family I cherish all things related to animals and travel.
I received my undergraduate degree from UTC in English with a minor in philosophy in 1996, my Masters in Business Administration with a concentration in Finance in 2003 and then went on to graduate 3rd in my class from John Marshall Law School in 2008. I was Managing Editor of the Law Review and interned at the Recording Industry Association of America (RIAA). I translated my passion for music to my passion for helping others.
Getting into Bankruptcy Law was something I found a deep passion for, because I got to help people who were really hurting and in desperate need. After working with one of the largest Bankruptcy firms in the Tennessee Valley and seeing first hand, how people were treated with little care or real personal attention, I decided to open my own practice where I could really do things right and truly provide the personal care, attention and respect I feel everyone deserves.
I’ve lived in the North Georgia/Chattanooga Area for most of my life. After graduating from Chattanooga Valley High School, I ended up working in Bankruptcy Law as a Paralegal and have stuck with it for the past 25 years.
