    A Fresh Start

In today’s day and age, Bankruptcy no longer carries the negative stigma it once did. With more people becoming educated to their individual rights and understanding that tough times can really hit anyone, we are helping our clients find the relief bankruptcy was designed to bring them.
It’s all about your right to a Fresh Start!
Remember “do overs” when we were kids? That’s what Bankruptcy is for us adults. It’s a do over, and is a legally protected right every American is entitled to.
You see, bankruptcy is not something for those who messed up and made bad decisions. Although bankruptcy can help you get out of a tight spot that maybe you got yourself into, it’s actually designed to help people who’ve had bad times find them! Bankruptcy is personal “insurance” to protect you from the “natural disasters” of LIFE.
We have clients who were running multi million dollar corporations and circumstances beyond their control, put their personal finances at risk, nearly wiping them out and landing them homeless. They claimed their right to a fresh start and were able to be absolved of the unfair circumstances that found them.
Working moms and dads have ended up in our office, good hard working folks who have lost a job, been swindled by a mortgage company or had a major medical emergency wipe them out. When big corporation comes after you, we are there to step in and say “enough is enough”, giving you back your life, your pride and shining hope back into an otherwise hopeless situation. This is what a fresh start is all about!
We’ve also had clients who were never financially educated and, in fact, most of us in America are not! Our education system in America doesn’t teach money management or credit management and this leaves the task to parents…and leaves many of us at risk. If our parents don’t have the ability to teach us, we are at the mercy of life lessons. We don’t look at situations like this any different than someone who did everything right and was hit from the side by an unexpected circumstance.
In fact, these cases are often the most important we can help. Because not only do we give you a fresh start through the relief Bankruptcy provides, we provide educational tools that help you onto a better financial path altogether. Many bankruptcy firms in the Chattanooga area simply want the numbers, they shuffle clients through like cattle, provide little even no support, and even miss some of the important details! The client suffers, but the attorney got their money and it doesn’t matter to them, they are just looking for numbers.
We are the bankruptcy firm that CARES for you, bottom line. We truly want to see you, no matter your situation or why you have ended up calling us or visiting, to find hope, help, and a financial future of prosperity and peace. This is why we put so much heart and hard work into every client and will do the same for you.
To find out if Bankruptcy is the best way for you to get your Fresh Start, call us right now and setup a FREE consultation with Millard Ramsey himself. Millard is a caring and kind heart’d bankruptcy attorney who will really help you find the best path that will benefit YOU the most.

    Filing Bankruptcy in Chattanooga

The Fresh Start of Filing Bankruptcy was meant to not only give you a new lease on life, but to protect you. We stop the bleeding, and protect you from any further attacks and injury by creditors…protecting your home, your car and your assets.
Creditors are trained at pushing the legal limits, and often are overstepping the bounds, bullying people into a state of surrender, stress and mental breakdown. We protect you from this abuse! If we determine that filing Bankruptcy truly is the best option for your case, you are immediately protected…literally within hours from filing with us.
And if any creditor tries to come after you, all you have to do is give them our number and they cannot call you again. And for every creditor who continues to harass you, they will be severely fined, regardless if they are a corporation or individual!
It should be common sense that someone can’t get caught up on debts, when they are being harassed or bombarded with excessive interest rates. Not only is it just technically improbably, it’s emotionally debilitating.
When we protect you from this sort of bullying through filing bankruptcy, we also give you something very crucial to your financial recovery and success…Your Pride and Confidence!
When filing bankruptcy is the smartest move for you to make, it’s something to be proud of, to stand by and claim and know that you took advantage of your right to a fresh start, to remove the unhealthy amounts of stress and grief, and get back on your feet. When you are severely injured, going to the hospital is the smartest place to go and nothing to be ashamed of. Bankruptcy is the protective healing “hospital room” for your financial well being.
Call today to setup your free consultation with Millard Ramsey, our caring attorney. You’ll get the answers and the help you are looking for and expert advice on what your next move should be.

    Chapter 7

A Chapter 7 bankruptcy is often called a “straight bankruptcy.” If you qualify for Chapter 7 bankruptcy relief, you can have most of your debt discharged in about six months. Contrary to what you may have heard, it is often possible to keep and pay for a house and a car while still discharging most of your other debts.
In order to determine if you qualify, your income must be evaluated using a court-order calculation called the “Means Test.” You must also take an inventory of your current assets. Our attorneys will assist you with both the Means Test and the asset inventory during the initial consultation.
If you decide to file a Chapter 7, your case will be assigned to a Chapter 7 Bankruptcy Trustee. The Trustee’s job is to make sure that both you and your creditors are treated fairly throughout the bankruptcy process. You will be required to attend a court hearing called a “341 Meeting of Creditors.” One of our attorneys will be sitting right beside you to assist you at the hearing. Normally the 341 Meeting of Creditors is the only court appearance you will have to make.

    Chapter 13

A Chapter 13 is a court-supervised debt repayment plan. Over a period of three to five years you will pay back some or all of your debt. Our attorneys will help you write a repayment plan based on how much you can afford to pay and the total amount of debt that you have. Even if you are behind on a house or a car, a Chapter 13 can allow you to keep them and pay off the amount you are behind over time.
Once your Chapter 13 repayment plan is filed with the court, there will be two court hearings. The first hearing is a 341 Meeting of Creditors. The second is called a “Confirmation Hearing.” You must attend the 341 Meeting of Creditors, but one of our attorneys will be sitting right beside to assist you during the hearing. Usually one of our attorneys can appear for you at the Confirmation Hearing without you needing to be there. At the Confirmation Hearing, a judge will review your repayment plan to make sure that it is both fair to you and to your creditors. Once the judge confirms your repayment plan, then all parties have to abide by the plan that was proposed.
You do not receive a discharge in a Chapter 13 until all of the payments have been made and the plan has been completed.
Bankruptcy is a big decision, and it is not the right solution for everyone. We offer a free, friendly consultation so that you can find out exactly what your options are. Our pledge to you is to make the entire process as convenient as possible. You can make an appointment to meet with an attorney in the office, or we can even come to you.

    Millard Ramsey

I am a native of Chattanooga, TN and as a passionate musician, I’ve played in various bands since I was a teenager. Besides my love of music, art, and my family I cherish all things related to animals and travel.

I received my undergraduate degree from UTC in English with a minor in philosophy in 1996, my Masters in Business Administration with a concentration in Finance in 2003 and  then went on to graduate 3rd in my class from John Marshall Law School in 2008.  I was Managing Editor of the Law Review and interned at the Recording Industry Association of America (RIAA). I translated my passion for music to my passion for helping others.

Getting into Bankruptcy Law was something I found a deep passion for, because I got to help people who were really hurting and in desperate need. After working with one of the largest Bankruptcy firms in the Tennessee Valley and seeing first hand, how people were treated with little care or real personal attention, I decided to open my own practice where I could really do things right and truly provide the personal care, attention and respect I feel everyone deserves.

    Teresa Wilson

I’ve lived in the North Georgia/Chattanooga Area for most of my life.  After graduating from Chattanooga Valley High School, I ended up working in Bankruptcy Law as a Paralegal and have stuck with it for the past 25 years.
Being a Bankruptcy Paralegal is truly something I love doing, because I get the deep privilege of helping people who are at a very vulnerable and difficult time in life. As attorney Millard Ramsey’s Paralegal I have the opportunity to really help people, and as a Christian that’s what I love most about my job here at Burk & Ramsey.
I love seeing the stress leave our clients when they leave our office…and that’s our primary purpose.

    Staci Lankford

I’m a Rossville, Georgia native and have lived here my entire life.  As a wife, mother and grandmother, I have an intimate understanding of how money problems can impact family…and am empathetic to every unique case that comes into our office.
After I became an LPN back in 2012, I felt God had a different path for me and made the decision to become a Bankruptcy Paralegal for attorney Millard Ramsey.  I’m grateful to be on this path, as I truly love what I do here in helping people heal from their financial wounds and relieve the mental anguish so many of our clients have been under.
